Agreement to Terms

Welcome to Level Up. These Terms of Service ("Terms") govern your access to and use of the Level Up website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service following any changes indicates your acceptance of the new Terms.

Description of Service

Level Up is an AI-powered job application assistant that helps users:

• Analyze job postings to extract key information
• Compare job requirements with their resume
• Generate tailored resumes and cover letters
• Track job applications throughout the hiring process
• Identify potential red flags in job postings
• Receive interview preparation guidance

Account Registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 16 years old to create an account and use the Service.

Acceptable Use

You agree not to use the Service to:

• Infringe on the intellectual property rights of others

• Your content does not violate any third-party rights
• Your content complies with these Terms and applicable laws

AI-Generated Content

The Service uses artificial intelligence to generate content such as tailored resumes, cover letters, and analysis. You understand and agree that:

• AI-generated content is provided as a starting point and should be reviewed and edited by you
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• You are responsible for reviewing and verifying all AI-generated content before use
• AI-generated content may not reflect your actual qualifications or experience
• You should not submit AI-generated content that contains false or misleading information

Subscription and Payments

Some features of the Service require a paid subscription. If you choose to subscribe:

• You agree to pay all applicable fees for your subscription plan
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Refunds are provided in accordance with our refund policy
• We may change subscription prices with notice to you

Payment processing is handled by our third-party payment processor. By providing payment information, you agree to their terms of service.

Intellectual Property

The Service and its original content, features, and functionality are owned by Level Up and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract source code from the Service

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM:

• Any warranty that the Service will be uninterrupted, secure, or error-free
• Any warranty regarding the accuracy of AI-generated content or job analysis
• Any warranty that using the Service will result in job offers or employment
• Any warranty regarding third-party services or content

Level Up is a tool to assist with your job search, not a guarantee of employment. Your success depends on many factors beyond our control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEVEL UP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Failure to obtain employment or job interviews
• Errors or inaccuracies in AI-generated content
• Unauthorized access to your account or data
• Any other damages arising from your use of the Service

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Level Up, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time through your account settings.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the United States.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Level Up regarding the Service and supersede all prior agreements and understandings.
